I've always hated the "earnest resistance" defense. It's archaic. Not all women react the same way in these situations. If they feel physically threatened, they may fear that "earnest resistance" could get them seriously injured, or worse, killed. So, they allow the rape to happen in order to protect themselves. Some women freeze up. 

That's the primary reason why this case was never prosecuted. He would have never been convicted. Sad story.
