Probably the precise wording of the law: The comedian known by Alabama football fans for his “How Alabama Fans Watch” videos was charged with inciting to riot. Under Alabama law, a person commits the crime of inciting to riot if he or she commands, solicits, incites or urges another person to engage in tumultuous and violent conduct of a kind likely to cause or create a grave risk of public terror or alarm. Comparing that with exactly what he said in full, where he urged them not to tear down local business like Target, or city hall, or various civil rights historical sites, etc but instead insinuated there might be something to take down at Linn Park (confederate monument), it probably didn't seem to rise to the level of "grave risk of public terror or harm."
