Lebo admits error; Tolbert still charged

Friday, October 12, 2007

AUBURN -- Auburn men's basketball coach Jeff Lebo said he was mistaken when he announced last week that all charges against senior guard Frank Tolbert had been dismissed.

Tolbert was arrested for drunk driving Sept. 20 and third-degree criminal mischief Sept. 21 in connection with an incident at an impound lot in which he allegedly drove his SUV through a metal fence.

Lebo issued a statement through the Auburn media relations office Oct. 4 saying all charges against Tolbert had been dropped. But as the Press-Register reported at the time, an Auburn municipal court clerk said there had been no change in the status of Tolbert's case.

An Auburn city attorney said the criminal mischief charges would be dropped because Tolbert had agreed to a restitution plan with the towing company. Messages left with the towing company and its attorney have not been returned.

Tolbert's court date on the remaining DUI charge is still pending for next week, although Lebo said it might still be resolved on or before the court date.

Lebo said Tolbert wouldn't be suspended for any games if he satisfactorily completes undisclosed in-house discipline.

"Is he in good standing with me? He's been in better standing," Lebo said. "He is currently being disciplined for a bad decision. He's a good kid and I love him, but he made a mistake and we're dealing with that."

Lebo said that forward Josh Dollard, who was arrested Oct. 3 on a misdemeanor warrant after he failed to pay a speeding ticket, would also face in-house discipline but not miss any games.

-- BASKETBALL INJURY WATCH: Auburn won't be at full strength when it opens practice today. Sophomore guard DeWayne Reed is at "85 percent" after breaking his foot this summer. Lebo said he should be fine by Auburn's first exhibition game on Nov. 1. Reserve guard Archie Miaway, who won't be eligible until January because of academic issues, is also nursing an injured knee.
