They are about to talk about possible problem with shirts being made with Cams name and other stuff, NBC13 out of B'ham coming up on the 10 oclock news. There really is nothing wrong, right? :beatmullet:

Surely not.  I don't see any way the NCAA can punish a player for something someone else does.  If Cam is getting no benefits from it, and someone just using his name, that would be crazy.  What is he supposed to do, copyright his name, and spend all of his free time suing everyone who uses it?  I could be wrong, but I see no way there could be any penalties if it isn't him or the school doing it.

No problem Auburn will probably have lawyers send out alot of cease and desist letters.  If that does not work lawsuits will follow.  But as long as cam gets no benefits.  Then it is not his problem.  It is Auburn university's problem and they will deal with it accordingly.

People selling all kinds of items with Cam Newton's image and name on it. Can't fault capitalism but I'm sure the lawyers get involved soon.  Auburn will not like to lose any revenue.  Especially on unliscensed items.

I had read posts about it on here and just thought I would let yall know there going to be talking it up on the B'ham news. Surely you guys are right there should be no way this goes any futher to harm our season.

As long as it's not officially licensed by AU, there is nothing the NCAA can do about it. You can't punish the university or Cam because some goob decided to print up a bunch of shirts.

Hate to say it, but it wasn't just one goob trying to make a buck.  We were out at the Ham last weekend and I bet 3 or 4 vendors come by trying to sell 'em.  Cam for Heisman and such.  Its funny how Auburn (the city) will grant a license for anything w/out asking questions, but then you start getting crap from the other side, bammerham newscast, etc.  My guess someone just handed Cam something and low and behold someone w/ a cell phone/camera takes a pic.  Get real bammers.

The real issue isn't NCAA violations, it's intellectual property rights.  Cam owns the right to his identity and any representation there of, but as a college football player, under NCAA rules, he can't make any money from it... so anyone making and selling Cam shirts are technically stealing from him, and putting he and the NCAA in a bad position.  Also, if they throw the Auburn logo on the shirts, they are also in violation of Auburn's property rights (and they are one of the most strict colleges when it comes to rights protection). 

All in all, it's a bad thing... so... make your personal Cam shirts as much as you want, but whatever you do, don't sell them!

Oh... and SWest.  NikeId is WELL aware of intellectual property issues (they caught a lot of flack when they first launched).  Don't be surprised if you get an email telling you they can't make your order if you referenced Cam's identity.

Yeah, considering Cam's not profiting or making them, and the university has nothing to do with them, there is no discussion here.

Of course, the University's stance will be to tell everyone to not buy unlicensed merch, bc they dont make any money off of it. Camzilla shirts, or NikeID shirts or whatever are no different than those knock-off orange Auburn jerseys you see people wearing sometimes....I seriously doubt lawyers are gonna come find you if you bought one, and i dont think anyone is wrong for buying one.  As someone brought up, EVERY school that has a upper-echelon player has shirts. Most likely just Bammer smoke and mirrors. I doubt it's gonna hurt us at all.....

They're filling the orders.  Go look at F-22's signature.  He has a pic of a cam shirt he just got in from NikeID

I agree totally, but you also have to consider the environment.  NCAA is well known for making players sit out while gray issues are resolved.  I have no doubt AU's lawyers and compliance are proactively running interference on this issue.  We need to make sure as fans we tow the line when the official statements are released.  Hopefully, it's much ado about nothing.

I am sure the University attorneys are on the case.  But as previously stated, as long as the player is not profiting from the sales, nothing can be done to the player or school by the NCAA.
