Wells Fargo bank foreclosing on Orlando man who paid on time, early

ORLANDO, Fla. —

A man who made loan modification payments on time and early said Wells Fargo stopped taking payments and started foreclosing on his house.

Etienne Syldor said he's worked his whole life for a home in Orlando for his wife and three children.

Syldor is an immigrant from Haiti and a bus driver at Walt Disney World. At times, he said he has worked multiple jobs to make sure he never missed a mortgage payment.

Last year, Wells Fargo offered him mortgage modification, and he was told if he made four monthly payments during a trial period, the modification would be permanent.

Court records show Syldor not only made the payments on time, but paid early and more than he was required to.

"And you didn't miss any payments?" asked Eyewitness News' Kenneth Craig.

"I didn't miss any," Syldor said.

"And you overpaid," Craig said.

"I overpaid," Syldor said.

It's why Syldor said he was in disbelief when the bank suddenly stopped taking his payments and sent him a letter telling him Wells Fargo was starting foreclosure proceedings.

Syldor hired attorney LaMya Henry, who's now fighting to save his home.

"When he came in and showed me all of the documents, it was just unbelievable," Henry said. "Who gets foreclosed on when they've made all payments on time?"

Three days after Eyewitness News contacted Wells Fargo, bank representative Veronica Clemons sent a statement:

"For some loans, completing trial payments is a significant step toward a permanent modification; however, in this instance, the loan was part of a mortgage-backed security and in a protected pool, with specific payment guidelines. We are working with Mr. Syldor to explain the guidelines and explore options that may help."

The bank told Eyewitness News Syldor didn't follow the modification guidelines because he paid early and sometimes his payments were sent one on top of the other.

Syldor said it doesn't make any sense.

Wells Fargo went on to say since Eyewitness News called, it now plans to reach out to Syldor to help him.

Eyewitness News will be in touch with him to find out if he's able to save his home.

Sounds like the bank messed this up and is now trying to look good by offering a new deal. Fine but the poor owner had to go through all this and hire a lawyer. The bank should pay his legal expenses.

Kim and i got a refi thru the VA a little over a year ago. It was factored out to...Wells Fargo Mortgage.

Folks, this is very very typical of Wells Fargo.

THEY DO NOT ALLOW PRE-PAYMENTS OR OVER PAYMENTS.

Paying your mortgage with them is an exact science. You pay the EXACT PAYMENT and they accept nothing more or less.

On their website, there is no other option other than THE PAYMENT. They do not allow partials, they do not allow any exceptions.

They treat you like dirt. I could go on and on.

We are running wide open now. TYL. But I was on 4 days a while back.

But we got behind. ONE PAYMENT BEHIND AND WERE MAKING PARTIALS to the local branch.

We made arrangements with Wells Fargo. They accepted the terms...AND THEN SENT PEOPLE OUT TO MY HOUSE TO EXAMINE THE PROPERTY AND TAKE PICTURES OF IT FOR FORECLOSURE PURPOSES. IT IS CALLED DUAL TRACKING AND IT IS ILLEGAL.

They continued to make harrassing calls 4-6 times a day, every day, even Sunday and weekends.

We quit counting at about 250 calls AFTER WE HAD MADE ARRANGEMENTS. I will never get behind, nor ahead with Wells Fargo ever again.

Now that we are "ahead," i am told that our over payments are "disallowed." The money goes into a "suspended account," It does not ever go into the mortgage. i was told they will not apply it either ahead of time, nor if you were behind, unless it somehow miraculously happened to equal exactly what you owed that day.

After the first few calls i was getting very pissed. i started asking questions and actually getting abusive right back at them.They could not have cared less.

I learned in all this, especially from their website, the representatives cannot accept partial payments, THEIR SOFTWARE WILL NOT ALLOW THE REPS TO TAKE ANYTHING BUT THE EXACT PAYMENT.

If you owe $700 and can pay $690, Wells Fargo will not accept it over the phone lines.

If you owe $700 and can pay $690, Wells Fargo CANNOT ACCEPT IT ONLINE. There is only a place for a full payment to be made. Unlike any other bank or credit firm, there are no other options.

If you owe $700 and can pay $690, Wells Fargo BANK will accept it at a branch office, but it will not be applied to your mortgage account until the full payment is made. It will be rolled into a "Suspended Account" and kept there. It will NEVER be applied to your mortgage.

Our last letter from WFM referenced the two partial payments we had made and WFB had accepted. It was a letter threatening us about the payments that we had made, totaling an OVERPAYMENT, and that they could not accept it. I had to get on phone and release the funds FOR THE EXACT PAYMENT ONLY from the "Suspended Account" for the payment. SMH...

I would, just despite. I hate Wells Fargo period. The only other options could be financing with another bank. I would not have signed a mortgage with WFM. I won't sign a mortgage with any bank, pay cash.

if you do need a refi or purchase PM me. my wife is an LO with 17years experience licensed in AL, TN, and KY. Wells Fargo is trying to hire her now, but she recently took a different job so she sets her own hours and sometimes works from home. The down side is she is now commission only.

They don't allow over payments, was that clearly specified in the Loan when you signed.

Nope, it was added on after the loan had been factored out.

That should be an important disclosure and banks shouldn't be able to change the terms of the loan. To me that's worth looking into further. The banks keep doing this, the trust will be going down.

Not allowing overpayments or partial payments is arbitrary bull**** designed to trip people up. And when it comes to financial matters, I'm totally an Elizabeth Warren fan.

These banks are a great example of how people talk morals and ethics yet have trouble using them while running their business. Seems like every large bank has paid hundreds of millions in fines for one lending violation or the other. Pure greed as old as the human being, still live and kicking.

You can find some sort of scandal in anyone's closet if you go back far enough. Heck, look at George (and Laura) Bush's history regarding drugs or driving under the influence. And it doesn't matter later if George's father and friends got him into the Air Guard or into Yale, for that matter. That's just life.

But if something is revealed about a liberal who wants to hold the establishment accountable, it becomes a "defining attribute", no matter how trivial.

I don't think she's any more "phony" than any other politician. This is another example of how you guys get played by special interests to reject folks looking out for your interests.

You can find some sort of scandal in anyone's closet if you go back far enough. Heck, look at George (and Laura) Bush's history regarding drugs or driving under the influence. And it doesn't matter later if George's father and friends got him into the Air Guard or into Yale, for that matter. That's just life.

But if something is revealed about a liberal who wants to hold the establishment accountable, it becomes a "defining attribute", no matter how trivial.

And this is why we have frauds all over DC. It's ok since "everyone" is a fraud, liar, or phony.

Well that's an extreme characterization. I would say that everyone is "human".
