Open Carry Texas. Will They Respect Others Rules

Whataburger will use its property rights to disallow open carry in their restaurants. It is predicted that many other restaurants will do the same. If you remember the Open Carry Activist were very adamant about open carrying wherever they please and were disrespectful to organizations that asked them not to do so.

Will be interesting to see if they respect the rights of others when it applies to open carry. Personally I suspect they will challenge those that use their property rights and see how far the restaurants will go to remove them.

One reason to open carry is states with laws like Alabama's. One needs a pistol permit to concealed carry but anyone with or without a permit can open carry.

One reason to open carry is states with laws like Alabama's. One needs a pistol permit to concealed carry but anyone with or without a permit can open carry.

It will be interesting to see how the status of anti-discrimination law vs. property/personal rights evolves over the next several years. One would have thought that discrimination of any kind in the the business/workplace was resolved with Brown vs. Board of Ed. and the Civil Rights Act of '64, but of course gender orientation and gun possession/display were not listed specifically in the latter as protected rights. But with the recent same-sex marriage ruling, I expect the courts to be busy for a few years addressing questions of to what extent business owners/retailers may or may not discriminate in the public market.

Although it may surprise some, given my generally liberal stance, but I'm not anti-2nd Amendment. I have enough libertarian lean to think there are things that are none of the government's business, including an individual's choice if he/she wishes to possess/use firearms, recreational drugs, adult pornography, or politically-controversial literature. At the same time, the freedoms protected in the Bill of Rights do come with restriction or limits. Freedom of religion does not grant me the right to practice human sacrifice, or even polygamy as of right now. Freedom of speech does not protect slanderous speech or yelling 'Fire!' in a theater. A free press does not mean a libelous press. And 2nd Amendment or not, does anyone think your neighbor should be free to stockpile weaponized anthrax, nerve gas, or nukes in his basement? Are bans on that sort of contraband an infringement on his right to keep and bear arms? I'm not against gun ownership, but I also don't see it as a Constitutional crisis of tyrannical intent to suggest some limitations in the interest of public safety.

Now for myself, I have no interest in keeping firearms, recreational drugs, or pornography at my house. I admit it makes me a little nervous to be around firearms although I've been hunting and target shooting on rare occasions. When I see a gun anywhere but a locked case, I worry about accidental discharge or negligent horseplay. But with the recent interest in carrying arms in public (concealed or open), I sometimes think about what might happen if a shooting erupted at a mall or theater full of armed citizens. Could we one day see a mass gun battle of strangers shooting almost randomly at each other In their vigilante enthusiasm, with no one really certain in the heat of the moment who the "bad' guys are vs. the "good" guys?

I don't get these open carry weirdos. If a lunatic wants to go in and shoot up the establishment they're in, the lunatic will just shoot them first and neutralize the immediate threat.

I guess the big questions is this:

Since an individual has the constitutional right to carry a firearm, and the SCOTUS has said gays have the constitutional right to marry, will one company be able to discriminate against gun carrying patrons, and another company will be fined/sanctioned for discriminating against gay couples?

If we are applying the rights equally, I would say Whataburger may be in trouble.

I ordered my food to go and while I was sitting texting on my phone a man maybe 5'3" on a good day with a crazy mustache walks out with a pistol on his side and just stares at me. He then gets into his pick up that has a huge confederate flag on the back. He backs it stops in front of me but he's driving in the parking lot and stares at me again then burns rubber and speeds off.....I really have to get a gun man

It was my first time eating there. It was good but the way I had heard people brag on it, I expected more. I'd take staggs in Florence over them if I had to choose

Well, exactly. I expect the courts will see a number of test cases in the near future to clarify these questions.

they do not have the best deals. Larry's pistol n pawn or academy sports has everything and more cheaper.
