Updyke indicted on 6 federal charges

OPELIKA, AL (WSFA) - The man accused of poisoning two historic oak trees on the campus of Auburn University is now facing federal criminal charges.

Attorney Glennon Threatt, Jr, attorney for accused Toomer's Corner tree poisoner Harvey Updyke, Jr. says his client, Harvey Updyke has been indicted in 6 federal charges.

He was already facing felony Criminal Mischief 1st Degree felony charges at a local level.

Threatt is going through the counts at this moment.

It appears federal prosecutors are charging Updyke with 2 counts of Criminal Mischief, 2 counts of Desecration and 2 counts of destruction of federal property.

WSFA 12 News will have more information as it becomes available later this evening.

Tuesday. it was reported that both trees on Toomer's Corner, considered century-old landmarks, are starting to show serious signs of poisoning.

I'm glad for once that the feds are jumping on too. Looks like the decision now is about which prison system state or fed gets him first.

I wonder what they are claiming as the damaged federal property? Is it because Auburn is a land grant university? Ground water contamination?

This was always going to be the biggie for Updyke. I don't know if the EPA's charges are included in those listed above or if they will be a separate set, but the federal angle is where he will get hit the hardest.

Also, look for the feds to sniff out Updyke's accomplice and bring him down as well.

Initial reports by a Montgomery TV station that Updyke also faced federal charges were later determined to be incorrect.

According to court documents, the grand jury indicted Harvey Updyke Jr. on two counts of first-degree criminal mischief, a felony charge; two counts of desecrating a venerated object, a misdemeanor charge; and two counts of unlawful damage, vandalism or theft of property from a farm animal or crop facility, a felony charge.

My problem with Updyke from the beginning was his defiance to the law. Almost two months after doing this and having time to think about it, Finebaum asked if it was against the law. He replied, "Do you think I care? I really don't". This is coming from former law enforcement, who if he had any remorse could have easily looked up the law on his actions. If he had even told Finebaum something like, "I haven't thought about that" or "I hope not" I could have some sympathy for the scumbag. Now he cares because he is feeling the ramification of his actions. TOO LATE! THROW THE BOOK AT HIM!
