Auburn, Sunny Golloway reach settlement in wrongful termination lawsuit Sunny Golloway's wrongful termination lawsuit against Auburn University has reached its conclusion nearly 20 months after it began. On Tuesday, the former baseball coach and the defendants in the case — Auburn's board of trustees, outgoing athletics director Jay Jacobs, former CEO David Benedict, senior associate athletic director Rich McGlynn, former director of baseball operations Scott Duval and baseball administrator Jeremy Roberts — reached an "amicable settlement of all issues," according to court documents filed on Thursday. Judge Charles S. Coody ordered both parties to file a joint stipulation for dismissal by Feb. 8. The case was originally set to go to trial on Oct. 15 of this year. Golloway, who coached Auburn's baseball team from 2014-15, was fired with cause on Sept. 27, 2015. His lawsuit fired against the university claimed breach of contract, defamation, fraud and tortuous interference. Coody dismissed all but one charge with prejudice on March 21 of last year. Golloway and his attorney, filed and objection and asked for a jury trial, which was granted for just one charge: Intentional interference of contractual relations. Because Auburn fired Golloway with cause, it did not have to pay him a buyout, which would have equaled the $1.25 million that remained over the final two years of his contract. The NCAA cleared Golloway of any Level I, II or major infractions during his time at Auburn on Jan. 30, but Auburn stated on Feb. 4 that it found four Level III violations and that his firing was accepted by both the SEC and NCAA. Terms of the settlement, if there are any, are not known. Prior to reaching the settlement, Saxon filed a motion to withdraw as Golloway's attorney citing "diverging views regarding themanner and means by which this case should be prosecuted," on Tuesday, but withdrew that motion to withdraw Thursday morning after he and Golloway reconciled their differences after "numerous phone conversations and email communications." So, if I understand this, these secondary violations are now considered "just cause" when a school wants to fire a coach, thus the door is pretty well opened for a school to avoid buyouts....just wait around until the guy make a couple ill-timed phone calls or texts.... and then fire him for cause. http://www.ncaa.org/level-iii-secondary-infractions-self-reporting Link to comment Share on other sites More sharing options...

Assuming Golloway got paid, Jacobs dodged a bullet and Auburn foots the bill. Again. steeleagle 2,945 Posted January 21, 2018 Share Posted January 21, 2018 Yep. This was another bad mark on JJ's resume. He or others forced him to find a way to get Golloway gone. Unfortunately, their case was weak when they fired him. Although, out of court settlements, also can mean that both sides were right on certain matters, and weak in others, so they better settle if neither side is sure they would win in court. Once the abrasive, arrogant bully became too much to deal with, Jacobs thought it would be okay to just do away with him. When Golloway dared him, Jacobs made up allegations and had Duvall provide old video as "evidence". The NCAA sided with the coach and cleared him of violations. As always, Jacobs thought he could do whatever he wanted and however he wanted to do it. Fortunately for us, those in position to do something had finally tired of that M.O. Ultimately we're better off with who we've got running the athletic department and far better off with who we've got running the baseball program. aubearcat 2,137 Posted January 21, 2018 Share Posted January 21, 2018 IMO, the AUburn baseball program is marquee enough that unless some outside factors happen, Butch will be here for a long time. With the AD, again the AUburn AD job is marquee enough that Greene will be here for a long time as long as he’s allowed to do his job freely.
