Alabama football fan Harvey Updyke has been arrested again, according to a report by the New Orleans Times-Picayune’s Katherine Terrell.

The 64-year-old Updyke, who has yet to be tried on charges of poisoning Auburn University’s Toomer's Corner oak trees, was arrested in Hammond, La., on Sept. 18 and booked into Hammond City Jail on charges of terrorizing, according to the Times-Picayune.

The arrest followed an argument over the return of a lawnmower,

Harvey Updyke was arrested in Hammond, La., on Sept. 18 after getting into a dispute at a home improvement store in Hammond over the price of a lawnmower, the Times-Picayune reported. After the argument escalated, the manager called the police, who heard Updyke make threats, including that he would "come back and take care of everyone."

Updyke was booked into Hammond City Jail at 6:21 p.m. and transferred to Amite Parish Prison on Sept. 19. There is also a warrant out in Texas on Updyke for the same charge.

Updyke gained national notoriety in 2010 for allegedly poisoning the Toomer's Corner oak trees on the campus of Auburn University. Updyke called into Paul Finebaum's radio show in January 2011 and admitted to poisoning the trees under the alias "Al from Dadeville." Updyke has pleaded not guilty to counts of desecration of a venerated object, first-degree criminal mischief and unlawful damage or vandalism of a crop facility.

Updyke ran into trouble again last week when attempting to return a lawnmower to a national home improvement store in Hammond. According to the police report , Updyke became angry when the store manager would only give him $110 for the lawnmower, and insisted on getting $150 for the product.

The police were called to the scene, and when the arresting officer arrived, he advised Updyke to call an attorney. Updyke refused and said "he would take care of this on his own."

"He had a sad story," said Hammond Police spokesman Lt. Vincent Giannobile. "He said he was going to prison anyway, he had a bad heart, and he didn't care. He kept insinuating that he wasn't going to take no for an answer."

Updyke said he would "come back and take care of everyone," after the officer on scene told him he was not allowed back on the property. According to the report, he continued to tell the officer he would return to the store and "it would be his last time."

Giannobile said the officer felt Updyke's statements and attitude were threatening, and arrested him.

"You just don't know what these people will do and we don't take any chances," Giannobile said.

Updyke was booked into Hammond City Jail at 6:21 p.m. and transferred to Amite Parish Prison on Sept. 19. Giannoble said all felony cases are transferred to the prison.

According to the police report, Updyke also has a warrant out in Texas for the same charge. He is also set to stand trial in Opelika, Ala., on Oct. 1 for the tree poisoning charges.

Updyke's trial could be delayed, as a judge has recently appointed new attorneys to his case.
