Auburn's Tolbert settles legal issues

AUBURN, Ala. (AP) — Auburn guard Frank Tolbert was found not guilty on a drunk driving charge and convicted of driving on the wrong side of a road.

A third-degree criminal mischief charge was dropped Wednesday in Auburn Municipal Court, the Mobile Press-Register reported on its Web site Thursday. Tolbert was fined $117 for the remaining charge.

Tolbert was arrested after allegedly jumping a fence at United Auto Collision to get his SUV, which had been towed earlier in the week for parking in a restricted area.

Police said Tolbert damaged a metal fence when he drove through it leaving the lot.

The towing service's owner agreed to drop the charges after reaching an agreement with Tolbert for restitution, court officials said.

A Municipal Court official said Tolbert was acquitted of the DUI charge because his estimated blood-alcohol content was .05, below the state's legal limit of .08.

Tolbert started 28 games last season, averaging 11.8 points and 4.8 rebounds.

Coach Jeff Lebo said last week Tolbert was being disciplined, but was not expected to miss any games.
