Correct if I'm wrong, selling the autographed memorabilia of active players is NOT against NCAA rules, UNLESS the player receives present/future benefit ?

The article has a point... why would you disassociate someone if it was found there was no wrong doing??  Also, can someone define a booster??  Your telling me this guy has never bought season tickets to UAt games??  I think season ticket holders are classified as boosters.  Am I way out in left field on this??

On another thread I think it said he had a skybox in his wifes name.  But I guess that would not make you a booster]

Actually, I think they were referring to the booster connected with the Albert Means 'nothing to see here because we investigated and found nothing wrong' story.

A player or university must take steps to stop the activity in order for the player to be eligible.  Alabama took a very ineffective step in December with it's cease and desist letter, with the hand-written scribble for the kiosk in the mall.  It does not appear that they took such steps toward the actual store, T-Town Menswear.  It is also questionable whether they took any actions in alerting the players to what was going on.  Nor did they appear to follow up with Al-Betar until March.  It fails the common sense test to think that Alabama and the players lived up to the standard in this bylaw.  It is clear from all of the pictures that Alabama players were aware that their jerseys were being used to promote a commercial product and that the players approved of that usage, as the players are standing next to displays of the memorabilia.  

Bylaw 12.5.2.2 Use of a Student-Athlete's Name or Picture without Knowledge or

Permission

If a student-athlete’s name or picture appears on commercial items (e.g., T-shirts, sweatshirts,

serving trays, playing cards, posters, photographs) or is used to promote a commercial product

sold by an individual or agency without the student-athlete’s knowledge or permission, the

student-athlete (or the institution acting on behalf of the student-athlete) is required to take steps

to stop such an activity in order to retain his or her eligibility for intercollegiate athletics.

The NCAA defines a booster as:

* An individual who is a member of the institution's athletics booster club.

* An individual who has made financial contributions to the booster club or the Athletic Department.

* An individual who is involved in providing benefits (e.g. summer jobs) to prospects or enrolled student-athletes.

* An individual who has been otherwise involved in promoting University of Alabama (i.e. buying season tickets).

It is hard to imagine that Al-Betar was able to sit in the box seats with Joe Namath and stand on the sidelines with Sedrick Irvin without making some financial contribution to Alabama.  I'm not authority on the matter by any means, but I also think that throwing Greg McElroy's signing party in January would be promoting Alabama, unless McElroy wasn't a student in the Spring.  Heck, I would think supplying Ingram his suit for the Heisman ceremony might make him a booster, but I may be stretching the 4th point too far.

This guys comment raises a good point I have not thought of before. Alabama has now damaged the store owners reputation. If they did it "for cause" then they are admitting NCAA rules were being broken. If they did it with no cause then Albetar has one heck of a law suit he can bring againt bama.

Glenn, am I missing something here? To me, that seems actionable against Alabama by Albetar. You can’t make a public denunciation against a private business person, damaging their personal and business’ public image and community goodwill without cause. And it appears that Alabama has stated Albetar was guilty of nothing that would have normally illicited being ‘Noticed.’

 

If Albetar could show that Alabama’s actions caused his business harm by the seemingly arbitrary and capricious Notice of Dissociation – always assuming that it’s true, that he broke no rules, isn’t a booster, yet gets dissociated – I’d at least be consulting with my attorney. Granted, I’d be closing up shop and leaving Tuscaloosa as I did it, which he may have to do anyway.

The Crimson Corruption runs very, very deep in this state! Why do you think they have skated on so many obvious violations in the past? They even have an insidious influence in the NCAA. Oh, I long for the day when total exposure is achieved!

I think for this case to really get going, some unhappy former players need to come forward. I am sure that there are a few....Saban has done enough of them wrong, therefore someone might turn on them. especially if a player is sitting back watching all the high profile stars get stuff for free.

Most programs get caught when someone involved gets pissed and goes to the media....USC, Oregon, SMU. Maybe the "Yahoo 10 article" is yahoo with evidence from pissed of players!
