Working to get squatting loophole changed in New York

For the life of me, I can’t understand how someone can occupy another person’s home and it be in any way legal.

It usually isn't.  In most jurisdictions, the problem has been getting the Sheriff's offices to charge them with criminal trespass.  In most of these cases, the squatters have been in the house for months before the owner either notices or contacts law enforcement.  That is why many of them consider the issue to be civil and tell the homeowner that they need to go the route of a dispossessory action to get a court order to have them removed.

Personally, if I went out of town for a couple of weeks and returned to find someone in my house, the Sheriff would be over that night to either respond to a shooting or give them a ride, but they would not be staying the night.
