State high court declines to hear Keller suit appeal

The Alabama Supreme Court has declined to hear the NCAA's appeal in the libel defamation suit of former college football booster Ray Keller.

The civil case was scheduled to begin last January in Jackson County Circuit Court but was delayed indefinitely because of the NCAA's appeal on Keller's status as a private citizen.

The NCAA argued that Keller was a limited public figure because of his profile as a successful North Alabama timberman and longtime Crimson Tide supporter.

``We were confident the judges would make the right decision and the Supreme Court would not disturb that decision," said Keller's attorney, Archie Lamb. "The burden of proof on a private citizen is much easier than it is with a limited public figure."

Keller filed suit in 2004 against the NCAA, recruiting analyst Tom Culpepper and others claiming his reputation was destroyed and business damaged. The NCAA put Alabama on probation in 2002 and accused boosters Keller, Wendell Smith and Logan Young of offering inducements to prep prospects.

The case will likely be rescheduled for the fall. :big:
