Alito splits with conservatives on first case

Votes to stop Missouri from executing killer contesting lethal injection

WASHINGTON - New Supreme Court Justice Samuel Alito split with the court’s conservative wing Wednesday night, refusing to let Missouri execute a death-row inmate contesting lethal injection.

Alito, handling his first case, sided with inmate Michael Taylor, who had won a stay from an appeals court earlier in the evening. Chief Justice John Roberts and Justices Antonin Scalia and Clarence Thomas supported lifting the stay, but Alito joined the remaining five members in turning down Missouri’s last-minute request to allow a midnight execution.

Maybe, JUST maybe, He voted for what he thought was RIGHT instead of checking to see what the party thought about it. I know this is a terrible thought, but, it has been a long day thus far. :blink:

ALITO'S FIRST BIG VOTE

Yesterday, in one of his first big votes on the Supreme Court, newly minted Supreme Court Justice Samuel Alito voted in a death penalty case. He refused to allow Missouri to execute a death row inmate, siding with the liberals on the court. The press is sounding the alarm...with headlines declaring that he is already breaking with conservatives. Well, not really.

Being for or against the death penalty is not a liberal or a conservative stand. It's an issue of personal conscience. Perhaps Alito felt, when reviewing the evidence, that a death sentence was not warranted in this case. Either he is against the death penalty, or he has a higher threshold for allowing it to take place than do some of the others on the court. Big deal. Who cares.

So..no need to panic just yet. Let's see how he votes on the important issues, like should the court revisit the Kelo decision. Then we'll know something. - Neal Boortz

See Kennedy was right, Alito is the end of the world for liberals.

In actuality, this is a perfect example of why we need to appoint very conservative jugdes to the SC. Judges, when they are no longer accountable, have this disturbing tendancy to become more liberal than they were when they were accountable. If you appoint a judge who is already a flaming liberal, you know he isn't going to become more conservative. We need more Robert Borks!!!!
