I was thinking about this this morning. I wondered if he maybe rushed him and they fell on the mower or something like that. I had someone fall on me while horsing around a few years ago and we landed on the edge of some steps. The edge hit right between 2 ribs and bruised me pretty bad. AUDub 11,158 Posted November 6, 2017 Share Posted November 6, 2017 No weapon. 1st degree requires using a weapon to cause serious physical injury. 2nd degree requires causing serious physical injury (no weapon). 3rd degree us assault on a privileged category. 4th is the catch-all. Serious physical injury = risk of death or prolonged impairment. Courts are known to be generous in their interpretation of serious physical injury, so don't be shocked if 2nd degree isn't coming down the pipe.
