Ed Enoch@EdEnoch 1m

Sentence is for 3 years but he must remain incarcerated for six months.

@EdEnoch 1m

Updyke has 104 days of jail credit and must serve 76 more, according to attorney Andrew Stanley

Under probation, he is forbidden from attending any collegiate sports event, has a 7 p.m. curfew and is banned from any AU property

This is a bunch of crap IMO. And I hope there is fiscal penalties to follow.

I had hoped for more, but if truth be told, I'm not sure he will survive 6 months in detention. I would like a financial penalty as well, minimally the expense that has occured trying to clean up his disaster, but if I'm not mistaken, he is all but destitute anyway. If there are any future earnings he should have to repay the recovery efforts, at the very least.

What an ignorant and sick little bastage. :beatmullet:

Only 76 more days? Uh..........no.

Just got the tweet. I'll wait until more details come out, but like you said you would think there will be some kind of financial penalties assed as well.

I don't think he will be able to abide by the probation conditions. "Not talk to the Media" He's never been able to keep his mouth shut.

Positive, He didn't get a kangaroo court to find him not guilty.

Negative - Pretty much everything else. 6 months gets him free in time for tailgating in T-town. ( Hey, tailgating isn't specifically a collegiate 'event', as long as he's not IN the stadium, right ? )

It's ok... He has set the standard for bammer fans.

If I had it my way, there would be no jail time... but, you'd bet your a$$ he would be at JHS after every home game cleaning the facilities! And then on sunday mornings, he's at Toomers cleaning up tp! Probation, financial reparations, and public humiliation is the only punishment I was hoping for!

note: There IS still time for somebody in the "good ol' boy network" to drive his a$$ down a dirt road (and leave him there)!!! - if you know what I mean ;)

He's in jail in Lee county now. Sounds like he will be a guest of the tax payers of Lee Country for another 76 days there. I doubt they would move him to state prison.

This plea deal is way too easy, but a ton of money has already been spent on this character. There needs to be large fine, even if he cannot pay it.

He has cost AU, the city of Auburn, Lee County and the state of Alabama millions of dollars, Try to save the trees, testing, removing soil, construction of a new corner area, his public appointed attorneys, his visits to the jail, police work, court time, DA time, ...... ,

Wasn't he banned from Bama games already, and yet he attended multiple games for free?

He was forced of campus last year when he was at a UAT softball game. The campus police escorted him off. He may have been at some UAT away games.

Unfortunately you're right... He would be free to tailgate all he wants.

If bammer had any class, they would ban him from the uat campus (not just from sporting events)!!! But, they don't.

Do not wish him physical harm.

Don't know why we should waste my hard earned tax money on his incarceration.

Agree that his punishment should be public humiliation and service to the institution he damaged.

He should be banned for the maximum jail sentence allowed to ever wear NCAA logo of any team, discuss a NCAA institution in public, attend in function and should not be allowed within 10 miles of a NCAA event.

Any state employee that shows support for him in public or by social media should be immediately terminated. (would be great to mine those threads and tweats, state should offer a bounty to anyone that could find those links)

Little doc

What about the Lee County DA that agreed to this? Any repercussions for him in future elections? I don't live there so I couldn't vote there if I wanted to.

District Attorney that agreed to this certainly owes on explanation. He is in jail until trial. Incremental jail days with this plea bargain is not much greater than he would serve if found not guilty at trial. Appears to me DA gave up possiblitiy for lot more jail time with little risk of servinmg less jail time. What am I missing? Financial penalties mean little to a deadbeat. A $500 judgement would bankrupt him.

My problem is the no restitution to Auburn University or the community. The money is insignificant, but he should have to provide services as restitution for his damage. http://www.thewareaglereader.com/2013/03/harvey-updyke-pleads-guilty-in-toomers-oaks-poisoning-case/#.UUzmAfF5mK0

I agree. He should have to make restitution. I am extremely disappointed by the outcome of the trial.

While this would be a just alternative it is not viable in that he just isn't worth all the trouble. Would you or I want to spend the money it would take to cover this up if the situation ever went south, IYKWIM. Let him spend the remainder of his days as the punchline to the bad joke that the 2010 Iron Bowl was on bammers everywhere!

Criminals deserve to be punished. Look at what happened to the sack dragger.

Public humiliation ? It's a moot point. He's already been treated as a hero by the vast majority of the tahd cult collective.

He'll be in stadium for a bama game, if not this year, by next year. Bank on it.

I don't doubt that one bit. Maybe T-Town Menswear will give him a job and buy him a season ticket.

More often than not, our judicial system seems to be a joke and this is a classic example of that. Terrible.

This dirt bag is getting off light. He will be out of jail in a matter of days but our tradition of rolling our precious oaks is gone forever. Seems like us Auburn Fans just received a life sentence of having to abstain from one of our most treasured traditions. I know more trees will be brought in and Toomer's Corner will be getting a facelift. This is all great, but it won't be the same. SCREW YOU Harvey Updyke and for that matter all of you trashy bammer fans. :realmad:
