FSU Under Federal Investigation for Handling of Winston Case

The only thing they could prove he was guilty of is that he had sex with her. Unless someone made a video recording (and maybe not even then) would they be able to prove anything else. So it boils down to a he-said/she-said dispute, and who you think is more believable. Given the experience of Brian Banks, I'm reluctant to jump to conclusions.

There was a video, but due to the TPD lack of urgency in investigating this matter, the teammate who shot the video deleted it a few days later.

What really bothers me is J Winston always says the typical "I owe it all to God" stuff. A truly religious and moral guy does not have sex with random girls, has teammates watching and recording, let alone force or rape a girl. I think he is low rent and yes I believe it was not consential. And what kind of person tapes people having sex like its a sport. The whole thing stinks and at least, let's say it wasn't rape, this poor behavior should not be tolerated by the coaches. It appears everyone went in as usual with no disciplinary action

Please don't say that a truly religious and moral person doesn't do bad things. Being a follower of Christ doesn't automatically make you humanly perfect. Hate it when people judge others like that.

Almost all of the focus is on the legal issues surrounding this case. Very little if anything at all has been mentioned about the moral and character issues of jw. Here is a guy that picks up a woman, takes her back to a room, has sex, allows on-lookers, has the event video'd. And I think that I have read that this is not the first of this type episode with jw either. If this is his mo, then it is only time before his adventures cost him.

He has some serious growing up to do. He could come across someone that is going to set him up. Could be gamblers or drug dealers. He could hook up with a girl who has a current or ex bf/husband that would at least hurt him if not kill him.

I agree. His behavior was trashy and callous at the very least. The whole incident is disgusting.

Big difference between how the football mill FSU handled this and how Vandy handled the assault up there last summer. Those people became ex Vandy players and students in a couple of days. Meanwhile they were also arrested.

after reading the NYT i stand by my previous hunch. i think she might have been drugged. if she honestly dont remember most of the encounter she had to have been. seems like the trip to the hospital would have tested for that. i would investigate him for a connection with whatever type date rape drugs are going around.

Many of those date rape drugs are quickly metabolized and do not show up in any drug screening even after only a few hours. Rohpynol and GHB are the 2 big ones, and LE has to get special testing done that is sensitive to those drugs even if they get the blood drawn in time.

All the while he was probably looking at himself thru a mirror and talking to himself as well. We all know jw loves jw!!

i still dont think it was preferential treatment. I could be wrong but cant make myself believe any self respecting administrator or LE officer would overlook rape for a football player(not even a starter) if he suspected guilt. i hope this was just incompetence.

Keep in mind that at the time, Winston was just another football player. You would have had to be a real college football junkie to even know his potential, and a real scumbag to give him preferential treatment based on that.

I think by preferiential treatment, I (and I think there article hit on this) was due to the fact that he was a football player, NOT that he was a star player.

DUI, Public Intoxication, Disturbing the peace, maybe, likely. Rape hell no. i just dont see it. i blame incompetence not favoritism. i cant digest overlooking rape.

The messed up thing in rape cases is that many people have a preconceived notion that if a girl claims rape, she might either be trying to cover her own indiscretions (a lot of these cases involve alcohol/drugs, which also clouds the issue), or she might have it out for the guy she is accusing. While various studies show that the actual incidence of false charges is anywhere from 2-10%, the fact that police and prosecutors find themselves facing these questions REALLY makes a mess of things. When you add to that, the pressure on police in college towns to "protect the team", you get people making monumentally stupid decisions about something that should be taken very seriously.

Let's face it, this isn't the first time a college football player has had rape charges roll off their back.

i think false rape claims happen more often than that when the accused is wealthy or potentially wealthy. i dont think this girl even knew who he was. if she was in her sober mind i doubt she even goes to his apartment. i dont know what happened here but the fact that the girl claims she dont remember most of what happened and there were no drugs detected means there was not enough to charge him. but i agree with the DA, the investigation was inept but a thorough investigation would have probably yielded the same result.

Google "rape culture" and you'll find tons of current articles. It's gotten really bad.

The problem is, it cuts both ways. The Duke lacrosse team and the Brian Banks story are two very public cases where young men's lives were ruined by false allegations. Far more women's lives are ruined by actual rape.

I think the problem lies in our sex-obsessed culture. Today's kids are sexting one another, and the girls seem to want it as much as the boys. Porn is everywhere, on smart phones and tablets and any computer. A lot of it is violent in nature, and viewing it constantly (even the non-violent stuff) desensitizes you to the fact that these are actual people with feelings, not just objects to satisfy your desires. It's even making its way into mainstream TV. I don't watch Game of Thrones, but I read about a violent rape scene that fans of the show seemed to pretend never happened. Maybe investigators treat rape that way because our society does.

I doubt there is a way to put the genie back into the bottle.
